Effective Immediately

1. Introduction and binding acceptance

These Terms of Use are a legal agreement between you and KurdeSIM™. These Terms govern your access to and use of the KurdeSIM™ website, mobile applications, digital eSIM products, order flows, account features, support channels, software interfaces, content, tutorials, social media content, notifications, communications, and any other services, tools, pages, features, or materials that we make available under the KurdeSIM™ name.

By visiting, browsing, creating an account, placing an order, installing an eSIM, using a QR code, downloading an app, interacting with support, using any feature, or otherwise accessing any part of KurdeSIM™, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not access, browse, purchase, install, activate, or use KurdeSIM™.

These Terms apply whether you access KurdeSIM™ directly, through an app, through a browser, through a checkout page, through a help page, through a social media link, through a referral link, through a QR code, or through any other digital path. Your agreement is formed at the earliest moment you access or use any part of KurdeSIM™.

2. Additional policies included in this agreement

These Terms are not the only rules that apply. By using KurdeSIM™, you also agree to our Privacy Policy, Refund Policy, Accessibility Statement, product descriptions, checkout notices, plan details, installation instructions, usage rules, support instructions, and any other posted or communicated rules that apply to the service you use.

If one policy refers to another, that other policy is incorporated into the agreement between you and KurdeSIM™. You may not claim that you accepted one policy while rejecting another policy that applies to the same order, account, product, or service.

If there is a conflict between a specific product notice shown at checkout and a general statement in these Terms, the more specific notice may control for that product or transaction, unless applicable law requires otherwise. If there is a conflict between the Refund Policy and a general refund-related statement in these Terms, the Refund Policy controls.

3. Definitions

For clarity, the following meanings apply throughout these Terms:

KurdeSIM™, we, us, and our mean KurdeSIM™ brand and the public-facing digital service made available under the KurdeSIM™ name.
Service means the website, app, checkout, account tools, support features, eSIM products, plan information, tutorials, content, communications, and related digital services we provide.
eSIM means an embedded SIM profile, QR code, activation code, data plan, connectivity profile, or related digital item that may be delivered, displayed, assigned, installed, or activated through KurdeSIM™.
Order means any purchase, attempted purchase, reservation, payment, checkout, transaction, digital delivery, or related fulfillment activity.
User, customer, you, and your mean any person or entity who accesses or uses KurdeSIM™.
Third-party providers means third-party telecom providers, payment processors, fulfillment providers, app stores, hosting providers, analytics tools, security tools, customer support tools, and other service providers that may support KurdeSIM™ operations.
Content means text, images, videos, screenshots, tutorials, logos, icons, interface elements, copy, designs, code, documentation, product data, social media posts, captions, voiceovers, downloads, and any other materials associated with KurdeSIM™.

4. Nature of the service

KurdeSIM™ is a digital eSIM and travel connectivity platform. We help customers purchase, receive, install, and use digital eSIM products through a modern online experience. KurdeSIM™ is not a mobile network operator, does not own every telecommunications network used by an eSIM, and does not control all coverage, routing, roaming, carrier policies, device behavior, local network conditions, or technical limitations that may affect connectivity.

Our service may depend on third-party telecom providers, fulfillment providers, payment processors, app stores, hosting providers, analytics tools, security tools, and customer support tools. We may change, replace, add, remove, pause, or update third-party providers at any time without naming them publicly and without requiring separate user approval.

You understand that eSIM service is not identical in every destination, device, carrier environment, or usage scenario. Speed, coverage, latency, signal strength, availability, routing, roaming behavior, compatibility, activation timing, and network stability may vary.

5. Public brand identity

The public-facing identity for these services is KurdeSIM™. You may see the name KurdeSIM™, KurdeSIM, or Kurdish Entrepreneurs in connection with the service. These references are part of the same public-facing brand identity unless a specific page clearly states otherwise.

No statement in these Terms gives you any ownership, license, partnership right, agency right, distribution right, equity interest, management right, voting right, resale right, or control right in KurdeSIM™, Kurdish Entrepreneurs, our brand, our platform, our accounts, our systems, our technology, our customer data, our content, or any digital assets used to provide the service.

6. Eligibility

You must be at least 18 years old, or the legal age required to form a binding agreement in the place where you access the service, whichever is higher, to use KurdeSIM™. By using the service, you represent that you meet this requirement.

If you access or use KurdeSIM™ on behalf of another person, business, organization, traveler, employee, family member, or device user, you confirm that you have full authority to do so and that the person or entity you represent agrees to these Terms.

We may refuse service, suspend access, cancel orders, restrict accounts, or request additional verification if we reasonably believe that a user does not meet eligibility requirements, provided false information, misused the service, or created legal, security, payment, fraud, or operational risk.

7. Account creation and account security

Some features may require an account, login, email verification, payment profile, order profile, app profile, or other customer record. You agree to provide accurate, current, and complete information when using KurdeSIM™.

You are responsible for maintaining the confidentiality of your login credentials, order details, QR codes, activation codes, account access, device access, payment credentials, and any other information used to access or use KurdeSIM™. Any activity occurring through your account, device, credentials, or payment method may be treated as your activity.

You must not share accounts, bypass login controls, use another person’s account without permission, create accounts using false information, create accounts for abuse, or use accounts to avoid restrictions. If you suspect unauthorized access, you must stop using the affected credentials and use the contact channels listed at the end of these Terms.

8. Customer responsibility before purchase

Before purchasing, you are solely responsible for reviewing all product information, plan details, destination coverage, data amount, validity period, activation instructions, device compatibility requirements, and any displayed limitations. You must make sure the plan you choose matches your device, destination, travel timing, intended usage, and technical ability.

You are responsible for knowing whether your device supports eSIM, whether your device is unlocked, whether your device supports the required network bands or configurations, whether local rules or carrier settings affect usage, and whether you can follow installation instructions without damaging, deleting, or misconfiguring the eSIM.

KurdeSIM™ may provide compatibility guidance, tutorials, screenshots, frequently asked questions, and support information. That guidance is informational only and does not remove your responsibility to verify your own device, plan choice, installation timing, and intended use before purchase.

9. Device compatibility

To use an eSIM, you generally need an unlocked, eSIM-compatible device and stable access to the required device settings. Certain devices, models, operating system versions, carrier-locked devices, restricted devices, modified devices, region-specific devices, enterprise-managed devices, or previously misconfigured devices may not support installation or activation.

KurdeSIM™ is not responsible for device incompatibility, locked devices, device defects, user configuration errors, manufacturer restrictions, carrier restrictions, operating system bugs, deleted eSIM profiles, unsupported settings, or inability to access device menus. Device compatibility is your responsibility.

Any list of compatible devices that we provide is general guidance only. Device models, software updates, carrier locks, regional variants, and manufacturer settings can change over time. If you are not certain that your device can use an eSIM, do not purchase until you have verified compatibility.

10. Installation and activation responsibility

You must follow installation and activation instructions carefully. This may include scanning a QR code, entering activation information, enabling roaming, selecting a cellular plan, checking APN settings, restarting the device, disabling conflicting settings, or contacting support through the channels listed at the end of these Terms.

You must not install the eSIM too early if the product details warn that the validity period may start upon installation, assignment, first network connection, first data use, or another activation event. You are responsible for understanding activation timing before purchase and before installation.

If you delete, remove, transfer, damage, misuse, share, expose, or fail to install an eSIM correctly, the eSIM may become unusable. KurdeSIM™ is not required to reissue, replace, refund, or compensate for an eSIM affected by user error, device behavior, deletion, failed installation, or unsupported device conditions, except where a non-waivable law requires otherwise.

11. Digital delivery

KurdeSIM™ products are digital products. Delivery may occur when an eSIM, QR code, activation code, order confirmation, download, installation prompt, customer account entry, email, app display, or other access method is issued, displayed, assigned, sent, made available, or otherwise provided to you.

Once digital delivery occurs, the product may be considered delivered even if you do not open the message, scan the QR code, install the eSIM, activate the plan, travel to the destination, use the data, or complete setup. Digital products are not physical goods and cannot be returned in the same way as physical items.

You must keep your order details, eSIM information, and QR codes secure. Sharing or exposing eSIM information may allow unauthorized use, theft, installation failure, or loss. KurdeSIM™ is not responsible for losses caused by your failure to keep eSIM information secure.

12. Plan details, validity, and usage limits

Each eSIM product may have specific plan details, including data amount, validity period, activation rules, destination coverage, network availability, supported usage, speed policies, fair-use limits, throttling rules, or other limitations. The product page, checkout page, confirmation page, account page, app page, or support information may display these details.

Plan validity may begin at purchase, delivery, installation, activation, first network connection, first data session, or another product-specific trigger. You are responsible for reviewing the applicable trigger before purchase. KurdeSIM™ is not responsible if you purchase too early, install too early, activate too early, delay travel, cancel travel, choose the wrong plan, or misunderstand the validity period.

Data limits, unlimited-plan fair-use limits, network priority, throttling, carrier policies, routing, and connection behavior may be controlled by third-party telecom providers and network conditions. KurdeSIM™ does not guarantee that all data plans will perform identically for every user or every device.

13. Network coverage and performance

Coverage maps, descriptions, destination lists, examples, and marketing statements are general indicators only. They are not absolute guarantees of availability, speed, signal, latency, routing, device compatibility, roaming availability, indoor coverage, rural coverage, building penetration, uninterrupted service, or carrier selection.

Service quality may be affected by terrain, buildings, device antennas, weather, local congestion, carrier policies, roaming agreements, local restrictions, network maintenance, outages, emergency conditions, security filters, device settings, account status, fair-use rules, plan limitations, and third-party provider systems.

You accept that eSIM connectivity may not be available everywhere, at every time, on every device, or with the exact quality you expect. You should maintain backup connectivity when connectivity is critical.

14. No emergency reliance

KurdeSIM™ eSIM products may be data-only products or may have limited features. They may not support voice calls, SMS, local numbers, emergency services, location-based emergency routing, or public safety communications. Product features vary.

You must not rely on KurdeSIM™ as your only method for emergency communications, urgent safety communications, medical emergencies, legal emergencies, payment emergencies, travel emergencies, or time-sensitive communications. Maintain a separate backup method if communication is important.

KurdeSIM™ is not responsible for emergency communication failures, inability to reach emergency services, lack of voice or SMS support, device limitations, network limitations, or any damages related to reliance on the service for critical communications.

15. Pricing

Prices may change at any time. Prices may vary by destination, plan type, data amount, validity, checkout flow, currency, taxes, fees, promotions, payment method, app version, website version, market conditions, third-party provider costs, and operational needs.

A price shown before checkout is not guaranteed until payment is completed and accepted. We may correct pricing errors, refuse orders affected by obvious errors, cancel suspected abusive purchases, or restrict purchases where a price, discount, coupon, or offer is used in a way not intended by us.

You are responsible for any taxes, fees, bank charges, payment processor fees, currency conversion fees, card issuer charges, wallet fees, dispute fees, or other charges related to your purchase, unless a checkout page clearly states otherwise.

16. Payments and authorization

By placing an order, you authorize KurdeSIM™ and our payment processors to charge the selected payment method for the order amount, applicable taxes, fees, and any other amounts shown at checkout. You represent that you are authorized to use the payment method.

We may use fraud checks, risk scoring, payment authentication, address verification, email verification, device checks, identity checks, order review, manual review, or automated review to protect the platform. We may refuse or cancel transactions that appear suspicious, unauthorized, fraudulent, abusive, high-risk, or inconsistent with these Terms.

Payment completion does not guarantee that an order will be accepted, delivered, activated, or retained if the transaction is later flagged, reversed, charged back, disputed, blocked, deemed unauthorized, or associated with abuse.

17. Order review and refusal

KurdeSIM™ may refuse, delay, cancel, limit, or manually review any order for security, fraud prevention, compliance, technical, operational, payment, risk, or availability reasons. We do not guarantee acceptance of every order.

We may cancel an order if we detect inaccurate information, suspicious activity, payment risk, unauthorized use, coupon abuse, policy abuse, inventory limitations, product unavailability, service limitations, or technical issues. If an order is cancelled before digital delivery, we may determine the appropriate handling based on the facts and applicable law.

We are not required to disclose internal fraud-prevention rules, risk scoring methods, provider relationships, security triggers, operational workflows, or technical decision systems.

18. Promotions, coupons, credits, and discounts

Promotions, coupons, credits, loyalty offers, referral offers, discount codes, and special offers are optional and may be created, changed, limited, suspended, revoked, or cancelled at any time. Unless clearly stated otherwise, promotional benefits have no cash value and may not be transferred, resold, exchanged, stacked, or used after expiration.

You must not create fake accounts, manipulate referrals, exploit checkout bugs, use unauthorized codes, use leaked codes, use employee-only codes, use private codes, resell discounted products, or use promotions in a way that harms KurdeSIM™ or other users.

We may cancel orders, remove credits, restrict accounts, refuse service, reverse benefits, or take legal action if we believe a promotion was misused.

19. Refund policy incorporated

All purchases are subject to the KurdeSIM™ Refund Policy. Because eSIM products are digital products that may be delivered immediately or near-immediately, purchases are generally final once an order is placed or a product is delivered, displayed, assigned, accessed, installed, activated, or made available.

You agree that device incompatibility, locked devices, incorrect plan selection, accidental purchase, duplicate purchase, change of mind, changed travel plans, delayed travel, non-use, partial use, dissatisfaction with speed or coverage, user installation error, failure to read product details, or failure to verify compatibility do not automatically create a refund right.

If a refund is required by a non-waivable law that applies to a specific transaction, we will comply only to the minimum extent required by that law. Otherwise, refunds are handled strictly under the Refund Policy.

20. Chargebacks and payment disputes

You agree to contact us through the channels listed at the end of these Terms before initiating a chargeback, payment reversal, payment dispute, or similar claim, unless applicable law gives you a non-waivable right to proceed otherwise.

Improper chargebacks, false disputes, friendly fraud, refund abuse, duplicate claims, payment reversals after digital delivery, or disputes made despite receiving the product may result in account restrictions, order cancellation where possible, denial of future purchases, preservation of transaction evidence, dispute defense, and legal recovery efforts.

We may submit transaction records, delivery logs, order confirmations, device or access logs, support communications, product data, payment records, and other evidence to payment processors, banks, fraud-prevention providers, or authorities when defending against disputes or abuse.

21. Customer support

KurdeSIM™ may provide support through digital channels, help pages, automated tools, ticket systems, chat, email, forms, tutorials, or other methods. Support availability, response time, language availability, escalation method, and resolution options are not guaranteed.

You agree to provide accurate order information, screenshots, device model information, settings details, error messages, and any other reasonable details needed to review your issue. Failure to provide requested information may limit our ability to help.

Support guidance does not guarantee that your issue can be resolved. Some issues are caused by device limitations, third-party telecom conditions, local network restrictions, payment risk, user error, or factors outside our direct control.

22. Acceptable use

You may use KurdeSIM™ only for lawful, personal, ordinary, non-abusive connectivity purposes unless we give written authorization for another use. You must comply with these Terms, all posted policies, product rules, third-party provider rules, app store rules, and applicable law.

You must not use KurdeSIM™ in a way that harms, disrupts, burdens, degrades, bypasses, misuses, exploits, or interferes with the service, our systems, our providers, our users, our payment processors, our networks, our brand, our security tools, our infrastructure, or our business relationships.

We may interpret and enforce acceptable use rules at our discretion to protect the service, other users, providers, and KurdeSIM™.

23. Prohibited conduct

You must not do any of the following:

use KurdeSIM™ for fraud, deception, unauthorized access, theft, abuse, or illegal activity;
provide false, misleading, incomplete, stolen, synthetic, or unauthorized information;
impersonate another person, business, support representative, brand, website, app, page, account, or authority;
resell, sublicense, redistribute, broker, share, transfer, rent, assign, or commercially exploit eSIM products without written authorization;
use stolen payment methods, compromised accounts, unauthorized wallets, fake identities, or disputed funds;
abuse refunds, chargebacks, coupons, referrals, credits, support processes, or fraud controls;
scrape, crawl, data mine, harvest, copy, index, mirror, train models on, or bulk-download our website, content, pricing, product data, support data, or customer-facing materials without written authorization;
use bots, scripts, automation, credential stuffing, account generators, bulk order tools, vulnerability scanners, or similar tools without written authorization;
reverse engineer, decompile, disassemble, bypass, probe, penetrate, modify, tamper with, or attempt to discover source code, systems, APIs, security controls, fraud tools, provider links, or infrastructure;
upload, transmit, introduce, or distribute malware, spyware, worms, ransomware, malicious code, phishing material, or harmful traffic;
interfere with network performance, carrier systems, provider systems, website operations, app functions, security tools, payment systems, or other users;
use the service for spam, unsolicited messaging, abusive automation, mass account creation, bot traffic, unlawful monitoring, harassment, intimidation, or threats;
use the service to create, support, test, or operate competing services, imitation services, clone services, or confusingly similar brands;
misuse KurdeSIM™ content, screenshots, logos, tutorials, UI, wording, product descriptions, or public materials;
harass, insult, threaten, defame, abuse, stalk, intimidate, or mistreat support staff, users, representatives, or any person interacting with KurdeSIM™;
claim affiliation, authorization, endorsement, partnership, agency, employment, distribution rights, reseller rights, or official status without written authorization;
do anything that may bring KurdeSIM™ into disrepute, cause legal exposure, create operational risk, harm provider relationships, or reduce service quality for other users.

24. Network abuse

You must not use any eSIM product to generate abusive traffic, automated traffic, artificial traffic, high-risk traffic, denial-of-service activity, botnet activity, credential attacks, spam, phishing, scraping, mass registration, bypassing blocks, circumventing restrictions, or activity that third-party telecom providers or security tools identify as abusive.

Third-party telecom providers may apply fair-use rules, throttling, restrictions, traffic management, filtering, suspension, or termination. KurdeSIM™ may also suspend, restrict, or cancel access where network abuse is suspected.

We are not required to provide advance notice before acting against network abuse, fraud, security risk, or activity that may harm our systems, providers, users, or brand.

25. No resale or redistribution

Unless we provide written authorization, KurdeSIM™ products are sold for the purchasing customer’s own authorized use. You may not resell, repackage, transfer, broker, distribute, list, advertise, assign, sublicense, rent, share, or commercially exploit KurdeSIM™ eSIM products or related materials.

Unauthorized resale may cause security risk, support confusion, brand harm, customer confusion, fraud exposure, provider violations, and payment disputes. We may disable, cancel, refuse, suspend, or investigate eSIMs or accounts connected to unauthorized resale.

No reseller, distributor, affiliate, influencer, marketing page, social media account, group, store, website, app, or person may claim official status without written authorization from KurdeSIM™.

26. No competing or cloning activity

You must not use KurdeSIM™ to develop, train, test, operate, market, benchmark, copy, imitate, scrape, or support a competing service, clone service, imitation brand, reseller scheme, confusingly similar platform, or functionality that competes with KurdeSIM™.

You must not copy our product pages, pricing structure, interface layout, screenshots, tutorials, wording, activation flows, help content, branding style, content strategy, app experience, support scripts, or customer-facing materials for a competing service.

This restriction applies even if copied material is modified, paraphrased, translated, rearranged, anonymized, reproduced through screenshots, recreated using AI tools, or republished through another website, app, social account, or business.

27. Brand and intellectual property ownership

KurdeSIM™ and Kurdish Entrepreneurs own or control the KurdeSIM™ brand identity, name, marks, logos, slogans, icons, app materials, website materials, interface designs, product descriptions, written content, tutorials, screenshots, videos, graphics, visual identity, social media content, help content, emails, software elements, workflows, layouts, and other protectable materials associated with the service.

All rights are reserved. Except for the limited personal use needed to access and use KurdeSIM™ as intended, you receive no ownership and no license to copy, reproduce, publish, distribute, sell, rent, transfer, modify, adapt, translate, scrape, reverse engineer, imitate, commercialize, or exploit any KurdeSIM™ content or brand asset.

Copyright, trademark, trade dress, database rights, design rights, unfair competition protections, confidentiality protections, contract rights, and other legal protections may apply. Misuse may result in account termination, takedown requests, payment restrictions, provider notifications, legal demands, injunctive relief, damages, cost recovery, and any other remedy available under applicable law.

28. Trademark and brand misuse

You must not use the name KurdeSIM™, KurdeSIM, Kurdish Entrepreneurs, or any confusingly similar, visually similar, phonetically similar, translated, misspelled, hyphenated, stylized, abbreviated, extended, or otherwise misleading version of the name in any way that may confuse users or suggest association with us.

This includes domains, subdomains, usernames, social handles, hashtags, app names, store listings, marketplace listings, groups, channels, community names, advertising accounts, landing pages, checkout pages, support pages, QR codes, logos, icons, banners, videos, thumbnails, captions, profile images, business names, product names, or email addresses.

You must not pretend to be KurdeSIM™, pretend to represent KurdeSIM™, copy KurdeSIM™ branding, operate fake support pages, create lookalike websites, create lookalike apps, use similar-sounding names, register confusing domains, create misleading ads, or redirect users in a way that creates confusion. We may act aggressively against impersonation and brand abuse.

29. Copyright and content protection

All KurdeSIM™ content is protected. You may not copy, download, screen-record, screenshot, duplicate, scrape, redistribute, translate, edit, remix, train AI systems on, publish, sell, sublicense, or commercially use our content unless we provide written authorization or unless applicable law gives you a non-waivable right to do so.

This protection applies to all public and non-public materials, including website copy, policy text, product descriptions, plan data, UI text, layouts, app screenshots, activation tutorials, help articles, marketing videos, graphics, voice scripts, captions, icons, social posts, and any other KurdeSIM™ material.

Unauthorized copying, use of confusingly similar content, or publication of materials that make users believe they are interacting with KurdeSIM™ may result in legal action.

30. Social media, public references, and reviews

You may refer to KurdeSIM™ honestly in ordinary reviews, comments, or personal discussions, provided that you do not misrepresent facts, misuse the brand, impersonate us, disclose private information, publish misleading claims, harass staff, promote unauthorized resale, or create confusion about affiliation.

You must not create social media pages, groups, channels, usernames, communities, bots, ads, or profiles that appear to be official KurdeSIM™ accounts unless we provide written authorization. You must not use our logos, app icons, screenshots, or brand identity to create a false impression of authority.

We may request removal, report abuse, submit takedown requests, restrict accounts, or pursue legal remedies if a public reference, review, page, listing, or social media account violates these Terms.

Official Social Media Channels: The only social media accounts, pages, groups, channels, or profiles recognized as official KurdeSIM™ channels are those directly linked from the footer of our official website at the time you access them. Any other account, page, profile, group, channel, ad, message, listing, reseller page, or community using KurdeSIM™, Kurdish Entrepreneurs, similar names, logos, screenshots, content, or confusingly similar branding is not authorized unless expressly confirmed by us in writing. We are not responsible for statements, offers, payments, support, refunds, links, files, downloads, messages, promotions, or claims made by unofficial accounts.

31. User content and submissions

If you submit messages, feedback, screenshots, reviews, suggestions, bug reports, ideas, support information, testimonials, comments, translations, complaints, or other content to KurdeSIM™, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable right to use, reproduce, store, analyze, adapt, publish, display, translate, and otherwise use that content for operating, improving, protecting, supporting, and marketing KurdeSIM™, subject to our Privacy Policy and applicable law.

You confirm that your submissions are accurate to the best of your knowledge, that you have the right to submit them, and that they do not violate any law or third-party right. You must not submit confidential information, personal data of others, illegal content, malicious files, or content you do not have authority to share.

We are not obligated to use, respond to, store, compensate, or credit any submission.

32. Feedback and ideas

If you provide ideas, feature suggestions, business ideas, product suggestions, design suggestions, workflow suggestions, content ideas, marketing concepts, names, translations, improvements, or other feedback, you agree that we may use them without restriction, compensation, credit, or obligation, unless we separately agree in writing.

You should not send us confidential business ideas or proprietary materials unless you are comfortable with this rule. Feedback sent to us does not create a confidential relationship, joint venture, partnership, employment relationship, consulting relationship, ownership claim, or right to compensation.

33. Third-party providers

KurdeSIM™ may depend on third-party telecom providers, payment processors, fulfillment providers, app stores, hosting providers, analytics tools, security tools, customer support tools, fraud-prevention tools, messaging tools, and other providers. These providers may have their own terms, policies, technical rules, privacy practices, compliance requirements, availability limits, fair-use rules, and operational procedures.

You agree that we may share information, transaction records, technical data, order data, usage data, support data, device data, fraud signals, or other information with third-party providers where reasonably necessary to provide the service, process payments, deliver eSIMs, troubleshoot issues, prevent fraud, comply with law, protect users, or protect KurdeSIM™.

We are not liable for third-party provider outages, restrictions, delays, policy changes, technical failures, coverage limitations, network performance, payment failures, app store decisions, hosting interruptions, security tool errors, or other acts or omissions outside our reasonable control.

34. App stores and device platforms

If you access KurdeSIM™ through an app store, device platform, browser, operating system, wallet, payment app, or other third-party channel, your use may also be subject to that third party’s rules. Those rules are separate from these Terms.

We are not responsible for app store review decisions, app availability, app removal, account restrictions, operating system changes, device platform issues, download failures, update delays, app permissions, device settings, or platform-level limitations.

We may update, change, remove, or restrict app features at any time for security, compliance, provider, product, or operational reasons.

35. Third-party links and external content

KurdeSIM™ may contain links, embeds, buttons, redirects, payment pages, app store pages, provider pages, help tools, or external resources operated by third parties. These are provided for convenience or functionality only.

We do not control all third-party content, availability, security, policies, or practices. Accessing third-party resources is at your own risk, and you should review any applicable terms and policies before using them.

A link or integration does not mean we endorse, own, control, guarantee, or accept liability for that third party.

36. Privacy

Your use of KurdeSIM™ is subject to our Privacy Policy. The Privacy Policy explains how we may collect, use, disclose, store, protect, and retain information in connection with the service.

You agree that we may process information as described in the Privacy Policy, including for order fulfillment, payments, fraud prevention, customer support, analytics, security, compliance, service improvement, and enforcement of these Terms.

You must not provide personal data of another person unless you have authority to do so and unless that person understands how their information may be processed.

37. Security and fraud prevention

We may use technical, operational, manual, automated, and third-party tools to protect KurdeSIM™ from fraud, abuse, spam, payment risk, chargeback abuse, account misuse, scraping, impersonation, cyberattacks, network abuse, policy violations, and brand misuse.

Security controls may include login monitoring, order review, payment verification, device checks, IP checks, rate limits, anomaly detection, traffic filtering, fraud scoring, account restrictions, manual review, support verification, and provider-level controls.

We are not required to disclose security controls, internal risk rules, fraud triggers, technical architecture, provider details, investigation methods, or enforcement criteria.

38. Suspension, restriction, cancellation, and termination

We may suspend, restrict, cancel, terminate, block, decline, or refuse access to KurdeSIM™, any account, any order, any eSIM, any transaction, any support request, or any feature at any time where we believe action is necessary for security, fraud prevention, compliance, technical stability, provider requirements, payment risk, policy enforcement, brand protection, or business protection.

We may act with or without prior notice depending on the situation. Notice may not be provided where doing so would create risk, expose fraud controls, harm other users, violate provider requirements, or interfere with enforcement.

Suspension or termination does not waive any rights we have under these Terms, including rights related to payment, refunds, chargebacks, intellectual property, brand misuse, indemnity, evidence preservation, and legal remedies.

39. Service changes

KurdeSIM™ may modify, update, suspend, discontinue, replace, add, remove, or restrict any feature, product, plan, destination, provider, payment method, support method, content, policy, pricing, app feature, or website function at any time.

We do not guarantee that any product, provider, destination, plan, price, feature, integration, app version, support feature, or content will remain available indefinitely. Digital services evolve, and changes may occur due to technical, legal, commercial, provider, security, or operational reasons.

We are not liable for changes that affect future availability, pricing, features, support methods, app behavior, destination availability, or product descriptions, except where applicable law requires otherwise.

40. Errors and corrections

KurdeSIM™ content may contain typographical errors, pricing errors, product description errors, availability errors, compatibility errors, translation errors, technical errors, or other inaccuracies. We may correct errors at any time.

If an error affects an order, we may cancel, correct, limit, refuse, or adjust the order where permitted by applicable law. We are not required to honor obvious errors, abusive uses of errors, or purchases made in bad faith.

You agree that you will not exploit errors, bugs, vulnerabilities, mispriced products, duplicate credits, coupon glitches, checkout bugs, or technical issues.

41. Communications and electronic notices

You agree that we may communicate with you electronically through the website, app, account pages, checkout pages, support tools, emails, notifications, messages, banners, policy pages, order pages, or other digital methods. Electronic communications may include order confirmations, delivery notices, payment notices, service alerts, policy updates, support messages, security notices, and other service-related communications.

You are responsible for keeping your contact information accurate and for checking your messages. We are not responsible if you fail to receive communications because you provided incorrect information, blocked messages, ignored notifications, used a full inbox, lost access to an email account, or used a third-party service that filtered communications.

Service-related communications are not optional where they are needed to provide, protect, or administer the service.

42. Marketing communications

We may send marketing communications where permitted by applicable law or where you have consented. You may opt out of certain marketing communications through available unsubscribe or preference tools, but you may still receive service-related, order-related, support-related, security-related, legal, or policy-related communications.

You must not use marketing messages, coupons, promotional content, or campaign materials for unauthorized resale, impersonation, scraping, misleading ads, or brand misuse.

43. Translations and language versions

KurdeSIM™ may provide content, policies, product descriptions, support information, app text, captions, tutorials, or communications in more than one language. Translations are provided for convenience and accessibility.

If a translated version differs from the English version, the English version controls to the maximum extent permitted by applicable law, unless a specific notice states otherwise or a non-waivable law requires a different result.

You are responsible for reading the version you rely on and asking for clarification through the contact channels listed at the end if you do not understand product details before purchase.

44. No professional advice

KurdeSIM™ does not provide legal, tax, immigration, travel, medical, safety, emergency, financial, or professional advice. Product information, travel connectivity guidance, compatibility guidance, tutorials, support messages, and help articles are provided for service-related assistance only.

You are responsible for your own travel arrangements, device decisions, connectivity needs, backup communication methods, compliance obligations, and professional advice needs.

45. Compliance with law

You must comply with all laws, rules, regulations, restrictions, carrier rules, payment rules, app store rules, and third-party provider rules that apply to your use of KurdeSIM™. You must not use KurdeSIM™ where doing so is prohibited or restricted.

You represent that you are not prohibited from using the service and that you will not use the service for illegal, restricted, sanctioned, fraudulent, harmful, abusive, or unauthorized activity.

We may restrict, cancel, or refuse service where we believe providing service may create compliance risk, legal risk, provider risk, fraud risk, security risk, or operational risk.

46. Export, sanctions, and restricted use

Digital connectivity services, software, app features, payment processing, and provider systems may be subject to legal restrictions. You must not access, purchase, install, or use KurdeSIM™ in a way that violates applicable export controls, sanctions restrictions, telecommunications restrictions, payment restrictions, or other legal limitations.

We may block, restrict, refuse, cancel, or review orders or accounts where required by providers, payment processors, app stores, compliance tools, or applicable law.

We are not required to disclose all legal, compliance, provider, or risk reasons behind a restriction.

47. Disclaimers

KurdeSIM™ is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted access, error-free operation, security, accuracy, compatibility, speed, coverage, availability, and performance.

We do not guarantee that the service will meet your expectations, that coverage will be available in every place, that speed will be sufficient for your use, that installation will succeed on every device, that third-party providers will operate without interruption, that payment methods will always work, or that content will always be accurate, complete, current, or free from errors.

No statement by support, marketing material, tutorial, compatibility page, coverage description, social media post, or representative creates a warranty unless explicitly stated in writing and signed by an authorized representative of KurdeSIM™.

48. Limitation of liability

To the maximum extent permitted by applicable law, KurdeSIM™ is not liable for indirect, incidental, special, consequential, exemplary, punitive, enhanced, or similar damages, including loss of profits, revenue, savings, data, goodwill, business opportunity, travel opportunity, communications, device access, account access, or reputation, even if we were advised of the possibility of such damages.

To the maximum extent permitted by applicable law, KurdeSIM™ is not liable for device incompatibility, locked devices, incorrect plan selection, user error, deleted eSIMs, installation failure, activation timing, changed travel plans, cancelled travel plans, non-use, partial use, speed dissatisfaction, coverage dissatisfaction, local restrictions, network outages, provider limitations, payment failures, app store issues, third-party actions, security incidents outside our reasonable control, or unauthorized account access caused by your actions or omissions.

If liability is imposed despite these Terms, our total aggregate liability for any claim related to an order will not exceed the amount you paid for the specific affected order, unless a non-waivable law requires a higher amount.

49. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless KurdeSIM™ from and against claims, demands, losses, liabilities, damages, costs, fees, expenses, investigations, penalties, chargebacks, payment disputes, provider claims, legal fees, and other costs arising from or related to your use of the service, your order, your account, your device, your payment method, your violation of these Terms, your violation of any other policy, your violation of law, your fraud, your misuse, your brand misuse, your unauthorized resale, your chargeback abuse, your content, or your infringement of any third-party right.

We may assume the defense and control of any matter subject to indemnification. You agree to cooperate with our defense and not to settle any matter in a way that imposes obligations on KurdeSIM™ without our written approval.

50. Evidence and records

You agree that our electronic records may be used to verify orders, delivery, access, support, account activity, payment activity, policy acceptance, installation support, fraud review, chargeback defense, and legal enforcement. Records may include logs, timestamps, emails, order pages, transaction IDs, delivery events, account events, support messages, screenshots, device information, IP data, fraud signals, and provider-related information.

You agree that electronic records can be valid evidence to the maximum extent permitted by applicable law.

51. Legal enforcement and remedies

If you violate these Terms, we may pursue any remedy available under applicable law or contract, including suspension, termination, order cancellation, refusal of service, account restrictions, evidence preservation, chargeback defense, takedown requests, platform reports, provider reports, payment processor reports, legal notices, injunctive relief, damages, cost recovery, attorney fee recovery where permitted, and any other appropriate action.

Misuse of the KurdeSIM™ brand, impersonation, fake support pages, confusingly similar names, unauthorized resale, copying, scraping, reverse engineering, fraud, chargeback abuse, or security abuse may cause serious harm. You agree that monetary damages may be insufficient and that equitable or injunctive relief may be appropriate where permitted by applicable law.

52. No waiver

If we do not enforce a provision immediately, that does not mean we waived it. If we allow a specific action once, that does not mean we allow it in the future. Any waiver must be in writing and expressly state that it is a waiver.

53. Severability

If any part of these Terms is found invalid, or unenforceable for any reason, the remaining parts remain in effect to the maximum extent permitted by applicable law. The invalid part may be modified or interpreted to achieve the closest lawful result.

54. Assignment

You may not assign, transfer, delegate, or sublicense any rights or obligations under these Terms without our written approval. We may assign, transfer, delegate, subcontract, or otherwise handle our rights and obligations in connection with service operation, restructuring, provider changes, business transfers, security needs, or legal compliance, subject to applicable law.

55. Force majeure

KurdeSIM™ is not liable for delays, failures, interruptions, restrictions, or losses caused by events outside our reasonable control, including provider outages, network failures, payment failures, app store issues, hosting issues, cyberattacks, technical failures, device platform changes, legal restrictions, regulatory actions, labor disruption, power issues, disasters, emergencies, or other events beyond our reasonable control.

56. Updates to these Terms

We may update these Terms at any time. The updated version becomes effective when posted, unless the update states a later effective date or applicable law requires another method.

Your continued use of KurdeSIM™ after updated Terms are posted means you accept the updated Terms. If you do not agree, you must stop using KurdeSIM™ and avoid placing further orders.

We may notify users of material updates through the website, app, email, account notice, checkout notice, policy page, or another reasonable method, but we are not required to provide individual notice for every change unless applicable law requires it.

57. Entire agreement for customer use

These Terms, together with the Privacy Policy, Refund Policy, Accessibility Statement, checkout notices, product details, app rules, support instructions, and any other posted rules that apply to your order or use, form the complete customer-facing agreement between you and KurdeSIM™ regarding use of the service.

No informal message, social media comment, support statement, marketing statement, tutorial, or general statement changes these Terms unless confirmed in writing by an authorized representative of KurdeSIM™.

58. Policy survival

Any provision that by its nature should survive termination or completion of an order will survive, including provisions related to payment, refunds, chargebacks, intellectual property, brand protection, prohibited conduct, privacy, evidence, disclaimers, limitation of liability, indemnification, enforcement, and dispute-related obligations.

59. Final agreement to all policies

By accessing, browsing, ordering from, installing, activating, or using KurdeSIM™, you agree to these Terms of Use and also agree to be bound by the KurdeSIM™ Privacy Policy, Refund Policy, Accessibility Statement, product details, checkout notices, account rules, app rules, support instructions, and any other applicable rules posted or communicated by KurdeSIM™.

If you do not fully agree to all applicable policies, do not use KurdeSIM™, do not create an account, do not place an order, do not install an eSIM, and do not access the service at all.
